Under the federal statutes, the term “trafficking” refers to a person who commits the crime of drug trafficking when manufacturing, distributing, dispensing, or possessing with the intent to manufacture, distribute, or dispense any amount of a prohibited narcotic.
Title 21 U.S.C.A. § 841, prohibited acts, provides:
(a) Unlawful acts
Except as authorized by this subchapter, it shall be unlawful for any person knowingly or intentionally–
(1) to manufacture, distribute, or dispense, or possess with intent to manufacture, distribute, or dispense, a controlled substance; or
(2) to create, distribute, or dispense, or possess with intent to distribute or dispense, a counterfeit substance.
Drug Trafficking Amount
Under the federal sentencing guidelines, drug trafficking offenses are triggered when a defendant is in possession of more than a specific amount of a prohibited substance.
The federal sentencing guidelines for drug trafficking recommend both minimum and maximum penalty for those convicted of a drug trafficking crime. In 2005 the Supreme Court of the United States issued a ruling in United States v Booker. The court ruled that judges are to consider the guidelines as advisory only.
The federal sentencing guidelines allow for lesser penalties under certain circumstances and when a defendant substantially assists the government. “Substantial assistance” means that the defendant has provided federal prosecutors or law enforcement agents with information that helps them prosecute other criminals. See U.S.S.G. section 5K1.1.
